As part of our long-term focus on companies active in the branded goods and design industry (household products, food and beverages, fashion and furniture classics), the pharmaceutical industry and in all areas of software development we advise on all aspects of the marketing and distribution of the products concerned. This includes not only the drafting and negotiation of license, distribution or franchise agreements but likewise the implementation and defence of selective distribution systems that are compliant with EU. In this context, we deal with both forms of “classic” sales promotion or questions specific to online distribution.
Of special importance is the intersection to antitrust law. Notable here is, on the one hand, our advice in connection with the implementation of distributions structures that stand up to all requirements under EU law. On the other hand, we advise and defend clients who (for example in the entertainment sector) can rely on the principles of free movement of goods and services and provide particular services outside the traditional market structures.
